1. Acceptance of these Terms

These Terms of Service ("Terms") govern your access to and use of the Magic Audiobook Player mobile application (the "App") for iOS and Android. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of the Service

Magic Audiobook Player lets you listen to audiobooks on your phone, browse a public-domain audiobook catalog, follow podcasts, and stream or download audiobooks from a Google Drive folder you choose. Optional AI features include "Story so far" recaps, narrated recaps, character lists, and cover art. The App is free and is provided to you on a personal, non-exclusive, non-transferable, revocable basis, subject to these Terms.

3. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you have the legal capacity to enter into this agreement.

4. Your Google Account and Drive Content

Google sign-in is optional for local and catalog listening. To connect Google Drive, you sign in with a Google account and grant the permissions described in our Privacy Policy. You retain ownership of your Drive content. The App reads the library you choose, stores sync data in its hidden app-specific Drive folder, and can upload audiobooks or save generated cover art when you request those actions. Robot-librarian access to a shared library folder is separate from Google OAuth access; disconnect the library in the App or remove that folder share to end it. The App does not access unrelated Drive content.

You are solely responsible for ensuring you have the legal right to use any audio content you place in your Drive folder, including books, podcasts, lectures, or other recordings. Catalog audiobooks and podcasts come from third-party sources; their availability and applicable rights can vary by title and location.

5. Price and AI Allowance

The App is free. It contains no ads and offers no purchases or subscriptions.

• AI features have a monthly allowance per installation of the App (for example, 2 recaps and 1 AI character list per month), shown in the App next to each feature. A use counts only when you receive a result. Allowances renew on the first day of each month (UTC).
• Daily limits also apply, and AI features may be paused for everyone for the rest of a day if a daily capacity limit is reached. A pause never uses up your allowance.
• We may change the allowance, pause, or discontinue AI features at any time.
• If we ever offer paid features, the price and terms will be shown in the App before you buy, and purchases will be handled by the Apple App Store or Google Play.

6. Acceptable Use

You agree not to:

• Use the App to play, transcribe, or generate recaps of content you do not have the legal right to use, including pirated audiobooks or copyrighted material you do not own a license to.
• Reverse-engineer, decompile, disassemble, or otherwise attempt to extract the source code of the App, except as permitted by applicable law.
• Circumvent the App's usage limits, allowances, or other protective mechanisms (for example, by reinstalling or scripting requests to reset them).
• Use automated tools, scripts, or bots to interact with the App or its backend service.
• Use the App to harass, harm, or violate the rights of others, including by sharing audiobooks you do not have the right to share.
• Use the App in any manner that violates applicable law or these Terms.

7. AI-Generated Content

AI features (recaps, character lists, narrated audio, cover art) generate output using third-party AI providers. The App labels these features as AI-generated before you use them, in line with applicable transparency requirements (including the EU AI Act). These features are still in development. You acknowledge that:

• You are interacting with an AI system when you use these features.
• AI output may contain spoilers for parts of a book you have not reached yet, despite our safeguards.
• AI-generated content may be inaccurate, incomplete, or contain errors. The App provides AI output as informational only — it is not a substitute for the original source material.
• AI providers may have their own usage limits, rate limits, or content policies that affect output quality or availability.
• We make no guarantee about the accuracy, fitness for purpose, or absence of bias in AI output.
• You are responsible for reviewing AI output before relying on it for any meaningful decision.

You can report a wrong, offensive, or spoiling result with "Report this recap" in the App or by email.

7a. Features in Development and Availability

Some features, including all AI features, are still in development and may change, be limited, or be removed at any time without notice. The App depends on services we do not control — such as Google Drive, the Internet Archive and LibriVox, podcast hosts, and AI providers — and parts of it may stop working when those services change or are unavailable. We do not guarantee that any feature, book, or recording will remain available.

8. Intellectual Property

The App, its design, code, artwork, and trademarks are owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

You retain all rights in any content you provide (audio files, bookmarks, playback positions). By using AI features, you grant us a limited license to process your content as necessary to deliver the feature you requested, as described in the Privacy Policy.

Copyright complaints. The App plays files that users choose from their own storage; we do not host or sell audiobooks. If you believe content made available through the App (for example through a listening link) infringes your copyright, email magicaudiobookplayer@gmail.com with the work concerned, where it appears, your contact details, and a statement that you are the rights holder or authorized to act for them. We will review the notice promptly and may disable access to the material and suspend repeat infringers.

9. Third-Party Services

The App works with third-party services including Google Drive, Google Sign-In, Cloudflare Workers, Firebase Crashlytics, Google Gemini, Google Search, OpenAI, xAI, Groq, Exa, Audnex, Google Books, Open Library, the Internet Archive and LibriVox, Apple's podcast search, and the hosts of podcasts you follow. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the acts, omissions, or content of any third-party service.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, OR ALWAYS AVAILABLE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE APP IS AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, OR OUR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED USD $50.

12. Indemnification

You agree to indemnify and hold us harmless from any claim, demand, loss, or damages, including reasonable attorneys' fees, arising out of (a) your use of the App, (b) your violation of these Terms, or (c) your infringement of any third party's rights, including content you store in your Drive folder.

13. Termination

You may stop using the App and revoke its access to your Google account at any time at Google Account Permissions. Uninstalling the App removes all locally stored data. We may suspend or terminate your access to AI features or other online services if you violate these Terms or for any reason at our discretion. Sections 8 (Intellectual Property), 10 (Disclaimer), 11 (Limitation of Liability), 12 (Indemnification), 15 (Governing Law), and 18 (General) survive termination.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected on this page with an updated effective date. Continued use of the App after an update constitutes acceptance of the revised Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the competent courts of Tel Aviv, Israel, except that you may also bring claims in your local small-claims court where applicable law permits.

Nothing in these Terms limits your statutory consumer-protection rights under the law of your country of residence.

16. Apple App Store Additional Terms

If you obtained the App through the Apple App Store:

• These Terms are between you and us, not between you and Apple. Apple is not responsible for the App or its content.
• Your license is limited to using the App on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
• Apple has no obligation to provide support or maintenance for the App.
• If the App fails to conform to any warranty, you may notify Apple, and Apple will refund the App's purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.

17. Google Play Additional Terms

If you obtained the App through Google Play, your use is also subject to the Google Play Terms of Service.

18. General

These Terms and the Privacy Policy are the entire agreement between you and us about the App. If any provision is found unenforceable, it will be limited to the minimum extent necessary and the rest will remain in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Headings are for convenience only.
